Rules and Regulations


1.01 Summary.  All use and restrictions listed in each of the covenants filed for the Lakes of River Trails Homeowners Association shall be enforced.  Violators of these use and restrictions will be fined according to fine structure outlined in Section 1.04 below.

Additional Use Restrictions. The following are additional use restrictions for the Lakes of River Trails Homeowners Association.

a)    Dogs must be on a leash when walked outside their homeowner’s property in accordance with Fort Worth Code Compliance.

b)    Animal waste must be picked up when walking their pet outside homeowner’s property.

c)    No motorized vehicles may be used on HOA common property and walking trails.  Exceptions are only vehicles used for handicapped persons or those used in HOA related tasks.

d)    All fences that may be viewed from public thoroughfares must be properly maintained by the homeowner. Specifically replacing broken pickets, fixing missing sections or correcting fences that are leaning.

e)    Lawns must be properly cut and edged and follow the City of Fort Worth’s guidelines.

f)    Common areas can not be used for temporary or permanent storage of personal items, lawn debris, or trash.

g)    No landscaping of any kind can be done by any home owner in any common area without the written approval of the Architecture Committee. Specifically plants, trees, steps, flower gardens, etc.

h)    All new, temporary, or permanent construction at any residence or lot within the Lakes of River Trails subdivision must be approved by the Architecture Committee.

i)    Failure to get Architecture Committee approval on any structures built on owner’s property may result in a fine and/or dismantling of the subject structure.

j)    No personal signs are to be placed on group mailboxes, street light poles, or any other object that a homeowner does not personally own. (i.e. garage sales, lost pets, etc)

k)    No vehicles shall be parked within 15 feet of the common postal boxes in Lakes of River Trails in accordance with Postal Regulations.

l)    An owner and/or his guests may not have more than 2 vehicles continually parked in the street regardless of where the vehicles are located.

1.03 Warnings and Fines. When any of the violations listed herein or in any of the Lakes of River Trails Homeowners Association’s covenants are reported, a warning letter will be issued.  If no action is taken to remedy the situation, a registered fine letter will be issued and a fine imposed on the homeowner.   If action is continually not taken, additional fines will be levied.

1.04 Fine Process. The following is the fine process that will be imposed when a violation has been confirmed by the HOA Board of Directors or their authorized representative.

a)    A courtesy letter is sent as a warning.  It will request that the homeowner remedy the violation within a week or a fine may be imposed.

b)    If the violation has not been corrected after a week from the first letter a registered certified letter will be sent to the homeowner notifying them that they will been fined $50 if the violation is not corrected.

c)    If the violation has not been corrected after a week from the second letter a registered certified letter will be sent to the homeowner notifying them that they have been fined $50 and will be fined another $50 if the violation is not corrected in two weeks.

d)    If the violation has not been corrected after two weeks from the third letter a registered certified letter will be sent to the homeowner notifying them that they have been fined another $50 and will be fined a $100 if the violation is not corrected in two weeks.

e)    If the violation has not been corrected after two weeks from the fourth letter a registered certified letter will be sent to the homeowner notifying them that they have been fined $100 and will be fined another $100 if the violation is not corrected in two weeks.  This process of fines of $100 will continue until the issue is resolved.

1.05 Liens. Non payment of fines may result in a lien placed against the property owner as explained in Section 12.07 of the Covenants.

1.06 Violation Statue of Limitations. If a homeowner commits the same violation in a period of less than six months from the time a violation was remedied, the fine process will continue at the point in the process where it ended. If a homeowner commits the same violation after six months from the time a violation was remedied, the fine process will start over.

1.07 Fine Appeals. A homeowner may appeal a fine or fines by sending a certified letter to the Board of Director for their sub area (North, South, East, West, or any subsequent area). The Board of Directors for that sub area (North, South, East, West, or any subsequent area) must review the appeal within 30 days and notify the homeowner of the results of the appeal.  If a response to the appeal by the Board of Directors for that sub area (North, South, East, West, or any subsequent area) is not made within 30 days, then any fines associated with that appeal are terminated and cancelled.

1.08 Fine Amount Adjustments. Only the Board of Directors for the same sub area (North, South, East, West, or any subsequent area) that a homeowner lives in may make any adjusts to the fine amount that a homeowner owes.
